- Members of Southern Sudan Assembly or Executive, and Governors and members of state legislatures or executives, shall not be eligible for membership of the National Legislature while occupying any of the aforementioned positions.

The mandate of parliamentarians from the south was terminated upon independence of the Republic of South Sudan on 9 July 2011. As a result, the statutory membership of the Council of States decreased from 52 to 32. The current legislature will complete its five-year term with this reduced statutory number. As at 25 July 2011, there were four vacant seats: two elected by the Kordofanian state legislature and two observers elected by the Abyei Area Council.
